Capital Real Estate Advisors and Capital Lending Resources, Inc. respect the privacy of our clients, prospective clients, business contacts, and website visitors. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information through our websites and how you may contact us about that information.

Please protect sensitive information.Do not place a Social Security number, bank-account number, password, government identification number, or other highly sensitive information in a general website contact form or ordinary e-mail.

Who we are

Capital Real Estate Advisors is the commercial real estate brokerage, investment, and advisory division of Capital Lending Resources, Inc., a full-service mortgage and finance company that has arranged and originated commercial mortgage financing since 1994.

In this policy, Capital Lending Resources, Inc., Capital Real Estate Advisors when it operates as a division of CLR, "Capital Lending Resources," "CLR," "we," "us," and "our" refer to the organization identified above.

This policy applies to the following websites and to pages, forms, and services on those websites that link to this policy:

  • This policy does not automatically apply to a separate affiliated company, lender, investor, service provider, or other third-party website. West Bay Capital, LLC is a separate affiliated company and provides its own privacy notice for its website and services.

Information we collect through the website

Depending on how you use the website and communicate with us, we may collect:

  • Contact information, such as your name and e-mail address.
  • Inquiry information, including the contents of a message you submit and any information you voluntarily include in it.
  • Subscription information, such as the e-mail address you provide to request updates.
  • Business and professional information you provide when asking about commercial financing, commercial real estate, lending, or related services.
  • Technical and usage information, such as Internet Protocol address, browser and device type, operating system, referring page, pages requested, date and time, and ordinary server, security, and error logs.
  • Cookie and similar-technology information used to operate, secure, and maintain the website.

How we collect information

We may collect information:

  • Directly from you when you submit a form, send an e-mail, telephone us, or otherwise contact us.
  • Automatically from your browser or device when you use the website.
  • From a representative you authorize to communicate with us.
  • From service providers that help us operate, secure, and maintain the website and business communications.
  • Information collected later in connection with an application, financing request, real estate engagement, or transaction may be governed by additional notices and agreements.

How we use information

We may use personal information for the purposes described below.

We will not use information collected through the website for a materially different purpose without providing appropriate notice when the law requires it.

  • Provide information about commercial mortgage, finance, lending, and commercial real estate services.
  • Evaluate or help arrange a requested service or transaction.
  • Communicate with clients, prospective clients, lenders, investors, counterparties, and professional advisers.
  • Send updates that a person requested and manage subscription preferences.
  • Operate, maintain, troubleshoot, secure, and improve the website.
  • Protect the website, accounts, information, and business from fraud, abuse, security incidents, and other unlawful activity.
  • Maintain business and transaction records.
  • Comply with licensing, regulatory, legal, tax, insurance, audit, litigation, and law-enforcement obligations.
  • Establish, exercise, or defend legal rights.

When we disclose information

We may disclose personal information as described below.

We do not sell personal information. We do not share personal information for cross-context behavioral advertising.

  • To employees and authorized personnel who need it to perform their work.
  • To website, hosting, e-mail, information-technology, security, records-management, and other service providers that support our operations.
  • To lenders, investors, brokers, escrow holders, title companies, appraisers, inspectors, consultants, and other parties involved in a service or transaction you request.
  • To an affiliated company when the disclosure is needed for a service you request, you direct or authorize the disclosure, or the disclosure is otherwise permitted by law.
  • To attorneys, accountants, auditors, insurers, and other professional advisers.
  • To regulators, courts, law-enforcement agencies, or other government authorities when required or permitted by law.
  • To protect rights, safety, security, property, transactions, or the integrity of our services.
  • In connection with a merger, financing, reorganization, sale of assets, or similar business transaction, subject to appropriate confidentiality and legal requirements.

Financial information and transaction notices

This website policy is not a substitute for a financial privacy notice required by the federal Gramm-Leach-Bliley Act, the California Financial Information Privacy Act, or another financial-services law.

When those laws apply, we may provide a separate notice explaining the nonpublic personal information collected in connection with a financial product or service, how that information is disclosed, the choices available to the consumer, and the measures used to protect the information.

If a separate financial privacy notice applies to a transaction, that notice controls for the information and practices it covers.

Cookies, browser signals, and third-party collection

The website may use cookies or similar technologies needed for functions such as page delivery, form operation, preferences, security, spam prevention, and troubleshooting.

You may be able to block or delete cookies through your browser. Doing so may prevent some website features from working correctly.

The website does not currently use personal information for cross-site behavioral advertising. Because there is no generally accepted standard for the browser Do Not Track signal, the website does not currently respond to that signal.

Where applicable law requires us to recognize an opt-out preference signal, such as the Global Privacy Control, we will process the signal as required.

We do not knowingly permit other parties to collect personally identifiable information about a visitor's online activities over time and across unrelated websites for those parties' own advertising purposes. Our operational service providers may collect technical information as needed to provide hosting, security, form processing, e-mail, or similar services to us.

Retention

We retain personal information for as long as reasonably necessary to respond to an inquiry or provide a requested service; maintain an active client, business, or transaction relationship; satisfy licensing, lending, real estate, financial, tax, employment, audit, insurance, litigation-hold, and other legal obligations; protect the company and others from fraud, abuse, and security incidents; and establish, exercise, or defend legal rights.

Retention periods vary by the type of information and the purpose for which it was collected. When information is no longer needed, we may delete it, deidentify it, or retain it in a protected archive when the law permits or requires that result.

Security

We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, and disclosure. Access is limited to people and service providers with a business need, subject to appropriate responsibilities.

No website, e-mail system, transmission, or storage system can be guaranteed completely secure. Do not send highly sensitive information through an ordinary contact form or unencrypted e-mail.

Your choices and requests

You may contact us to ask what personal information we maintain about you through the website; request correction of inaccurate contact information; request deletion of information that we are not required or permitted to retain; unsubscribe from requested marketing or informational e-mail; or ask a question about this policy or our privacy practices.

We may need to verify your identity and authority before acting on a request. We may deny or limit a request when retaining or using the information is permitted or required for a transaction, security, fraud prevention, recordkeeping, legal compliance, litigation, or another lawful purpose.

If the California Consumer Privacy Act applies to us or to particular information, we will provide the rights required by that law, subject to its exemptions and verification requirements. Certain information governed by federal or California financial-privacy law may be exempt from some California Consumer Privacy Act requirements.

e-Mail choices

You may unsubscribe from an optional marketing or informational e-mail by using the unsubscribe method in the message or by contacting us. We may still send nonmarketing communications concerning a request, transaction, account, security matter, or legal obligation.

Children

The website and our services are intended for commercial and professional users and are not directed to children under 13. We do not knowingly collect personal information online from a child under 13. A parent or guardian who believes a child submitted personal information may contact us to request review and appropriate deletion.

Changes to this policy

We may update this policy as our services, technology, or legal obligations change. We will post the revised policy on the website, change the effective date, and provide additional notice of a material change when appropriate.
